Terms and Conditions – Cancellation Policy
‘Eudaimonia’ is the trading name of Eudaimonia Private Tours of Greece, a tour provider officially registered under the Greek National Tourism Organization with business license number: 1245E70000044101. The ‘client’ or ‘customer’ is the person or persons who have made a confirmed booking with Eudaimonia.
The ‘client’ is the person or persons who have made a confirmed booking with “Eudaimonia“.
Acceptance of Booking
☼ A booking is accepted by Eudaimonia, only when we have received at least a 30% deposit and confirmed the booking by email if the booking is made more than 60 days in advance of the tour departure.
☼ Booking is also fully accepted by Eudaimonia when we have received full payment and confirmed the booking by email if the booking is made less than 60 days before the tour departure.
☼ On receipt of payment as detailed above, subject to availability and at our discretion, Eudaimonia will reserve the client’s tour.
☼ Payments made by Paypal, either through Eudaimonia’s website or directly, are subject to an additional cost of 5%-6% and payments by Amex are subject to an additional 2.80%-3%, which the client must pay to Eudaimonia before the day of the tour. These are the approximate fees that Paypal and Amex charge on all transactions. There is no extra charge if you pay by any other credit card.
(A) Cancellation Policy for the day or half-day tours or transfers:
☼ Cancellations made greater than 40 days prior to the scheduled tour date will be fully refunded minus expenses and/or services fees.
☼ Cancellations made between 30 to 40 days prior to the scheduled tour date will be refunded 80% of the agreed total tour fee.
☼ Cancellations made between 20 to 5 days prior to the scheduled tour date will be refunded 50% of the agreed total tour fee.
☼ Cancellations made 5 days prior to the scheduled tour date will incur a 100% charge.
Additionally to the above but after the 40-day full refund period, all of Eudaimonia’s expenses agreed upon through the email exchange of communication concerning the day or half-day tours or transfers, such as site tickets or train tickets or bookings for the client (train/ boat tickets, wine tasting, restaurants, etc) will be deducted from the amount to be refunded.
Finally, a service fee of 8% (of the total amount agreed) will also be deducted from any refundable amount including the 40-day full refund case. This corresponds to the time spent on the client’s booking.
(B) Cancellation Policy for multi-day tours:
☼ Cancellations made greater than 60 days prior to the scheduled tour date will be fully refunded minus expenses and/or services fees as mentioned below.
☼ Cancellations made between 60 to 30 days prior to the scheduled tour date will be refunded 80% of the agreed total tour fee minus expenses and/or services fees.
☼ Cancellations made between 30 to 20 days prior to the scheduled tour date will be refunded 50% of the agreed total tour fee minus expenses and/or services fees.
☼ Cancellations made 20 days prior to the scheduled tour date will incur a 100% charge.
Additionally to the above but after the 60-day full refund period, all of Eudaimonia’s expenses agreed upon through the email exchange of communication concerning any multiday tour, such as site tickets, train tickets, hotels booked for the client, and other bookings (like wine tasting, restaurants, etc), will be deducted from any amount to be refunded after the initial 60-day full refund period. This will be an amount of 25%-30% of the total tour cost.
Finally, a service fee of 15% of the total amount agreed will also be deducted from any refundable amount including the 60-day full refund case. This corresponds to the time spent on the client’s booking.
(C) Special client-specific arrangements/agreements:
It is possible that there will be client-specific payments & bookings (full or partial) agreed upon through e-mail communication mentioned -for example- as “non-refundable”. Then, these client-specific agreements will precede any other interpretations made from this cancellation policy, and it is only at Eudaimonia’s discretion to refund fully, partly, or not at all, even under certain conditions including “Force Majeure”. Therefore, it is the specific written (email) agreement between each client and Eudaimonia that can only precede this main cancellation policy -if it is different- and determines the agreed cancellation policy for each client.
D) Other issues:
Eudaimonia reserves the right to make subtle changes to tour itineraries. Eudaimonia reserves the right to substitute vehicles and/or drivers should they arise. Eudaimonia reserves the right to change or cancel your booking in accordance with operating requirements or circumstances beyond its control. Should change and/or cancellation prove necessary we will give you reasonable notice thereof, in the circumstances, & where available, offer you a comparable alternative. If an alternative is not available or acceptable you will be entitled to either a full refund or monies paid by you to us or you can transfer to another Eudaimonia tour without payment of any transfer fee.
Eudaimonia encourages all clients to communicate as early as possible concerning cancellation issues which can allow the agency to offer a better refund – partial or full- to a client despite the standard policy described in this document. This is a decision to be made entirely by Eudaimonia in an effort to better serve the client.
Eudaimonia itineraries are flexible, and if possible, the requirements of clients will be facilitated. Eudaimonia reserves the right to vary, modify or cancel any itinerary, either partly or wholly. Itineraries published are sample itineraries only and may be amended without notice. Eudaimonia also reserves the right to use alternative vehicles to those advertised.
Eudaimonia is not responsible for the costs of any other travel arrangements affected due to our cancellations or rescheduling of any tour departure.
Dietary requirements must be requested from clients and forwarded at the time of booking or at least one week before the tour.
Bookings can only be used by the client/s to whom the booking was initially arranged; no other person can use the booking in any circumstances.
The client may also be asked to produce a valid photo or/and passport number identification.
Insurance
☼ The client’s booking does not cover travel insurance.
☼ Eudaimonia strongly recommends that the client purchases travel insurance cover for cancellation, medical expenses, personal accidents, personal luggage, money, and public liability before you travel. The client should ensure that any activities undertaken by the client during the Tour are covered by their insurance, in this regard, please note that certain activities may require specific insurance and it is a matter for the client to ascertain the position with their insurer before partaking in any activity. Eudaimonia accepts no responsibility for loss or personal damage to personal belongings or liability for personal injury/death.
☼ The client’s travel insurance will need to cover anything from cancellations for simple personal issues, health, accidents, etc but also for any circumstances of “force majeure”.
Holiday Conditions
☼ Our Eudaimonia tours are not physically active, with varying levels of demands and fitness requirements depending on the specific itinerary and duration of the tour. By booking your tour, you represent that you do not have any physical or other conditions that would create a hazard for you
☼ If you have a physical or medical condition, dietary restriction, or other condition that will require special attention during the tour, you must inform us in writing when the booking is made.
☼ Please be aware in this regard that participation in each activity is a matter for the client on a day-to-day basis during the tour. If you do not want to participate in a particular activity, please let the Eudaimonia Representative know.
☼ Eudaimonia assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.
☼ The client is responsible for all travel arrangements and costs to/from the point of commencement/conclusion of the tour.
☼ The client agrees that Eudaimonia may take photographs and videos of the client during the tour. These may be used in Eudaimonia brochures, electronic media (website, Facebook, youtube, etc), and/or other means of advertising after obtaining consent from the client.
☼ The contract and all matters arising in respect hereof shall be subject to Greek law and the jurisdiction of the Greek Courts unless we agree otherwise in writing.
☼ If any provision of these terms and conditions is held invalid or unenforceable by any court of competent jurisdiction, that provision shall be deemed to be re-written to give effect to the same purpose within the permitted limits of the law. The validity and enforceability of the other provisions shall not be affected.
☼ If the client is unsuccessful in any legal action instituted against us, the client agrees to pay all our costs, including, but not limited to, legal costs.
☼ Clients must be aged 18 years and over. Children must be accompanied by at least one adult. Children must be at least 8 years old unless it is agreed upon differently and in writing (email). In all cases and for both adults and children, car sickness is the clients’ responsibility, and in the case of such an event, the clients will be charged an extra 300 EUR minimum depending on the extent of the damage. The client needs to notify Eudaimonia in advance so that precautions can be taken from both sides.
☼ You agree that the sole remedy for any default by Eudaimonia arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Eudaimonia shall not be liable for any special, consequential, indirect, incidental, or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under the statute, in equity, at law or otherwise, even if Eudaimonia has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
Weather Conditions & Force Majeure
☼ The client accepts that certain activities and aspects of Eudaimonia tours are weather dependent and that under no circumstances can Eudaimonia be held responsible for weather conditions. The client will be informed by email about possible weather problems or difficulties and will be asked to make a decision -in agreement with Eudaimonia- for attempting the tour or not. In this case, and if the tour finally does complete, the client will not claim any refund.
☼ Eudaimonia will not be deemed in breach of these terms and conditions or otherwise liable to you, because of delay in performance or nonperformance of any of its obligations under these terms and conditions to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Eudaimonia, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, volcanic ash clouds, and unforeseen circumstances.
☼ If Eudaimonia and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement about the tour. Regarding civil unrest, once Eudaimonia has investigated the prevailing situation, it shall remain in Eudaimonia’s sole and absolute discretion whether to commence or proceed with a tour.
☼ If a tour has to be canceled by Eudaimonia due to Force Majeure then the client will be offered a credit for an alternative tour at a later time up to 18 months from the original tour date.
☼ If a tour has to be canceled by the client due to “Force Majeure” the client can only be compensated by his/her own travel insurance which Eudaimonia highly recommends.
Vehicle Smoking, Drinking & Eating Policy
☼ Eudaimonia operates a strict no-smoking policy on all its vehicles and tours. Drivers/guides are all nonsmokers. Clients will also not be allowed to smoke in the vehicle.
☼ Similarly, drinking or eating in vehicles is not allowed except for bottled water.
General
☼ The booking conditions detailed herein, together with the Waiver of Liability, contain the entire contract between the client and Eudaimonia. No representation, term, warranty, or condition can be expressed or implied by reference to any other writing, advertisement, or conversation. This contract may only be varied in writing by a duly authorized Director of Eudaimonia.
☼ The client’s contract is with Eudaimonia as the tour operating company. At any time and at Eudaimonia’s discretion, we may nominate to the client in writing any other company or person to have the benefit of some or all of those provisions of this contract, which Eudaimonia may then specify as if the client had agreed on the provisions directly with that company or person in the first place as well as agreeing on them with Eudaimonia. Eudaimonia may, at its complete discretion, assign all or any rights and liabilities arising under or by this or any other contract with the client.
VALIDITY & DISPUTES
The above terms and conditions are valid for all bookings submitted after January 1, 2021. Any tours booked/submitted on previous dates are subject to the initially agreed terms shown in the corresponding communication/email which, in all cases, would have been “non-refundable”. However, we offer credit for the rescheduling of such tours until June 30th, 2022.
Any disputes will be resolved by the Greek legal system and its laws without the need for any arbitration.
The Client agrees to all the above when booking any of Eudaimonia’s tours and services.
